General Terms and Conditions (GTC) – Hebamme Susanne Knauer, 61352 Bad Homburg

 

1. Scope of Application

These General Terms and Conditions (GTC) apply to all midwifery services provided by midwife

Susanne Knauer, Foellerweg 30, 61352 Bad Homburg, to clients.

Deviating agreements shall only apply if confirmed in writing.

 

2. Range of Services

The midwife offers services within the scope of pregnancy counseling, childbirth preparation, postnatal care, counseling for breastfeeding and nutritional issues, as well as course offerings (e.g. postnatal recovery exercise, baby massage).

The exact scope of services results from the individual care agreement or the respective course description.

 

3. Conclusion of Contract

A care contract is concluded as soon as an appointment is agreed upon or a course place is bindingly booked.

The midwife reserves the right to decline inquiries in the event of capacity constraints or an unsuitable care situation (e.g. distances).

 

4. Fees and Billing

 

  1. Remuneration for midwifery services is based on the respectively valid Midwifery Services Remuneration Agreement pursuant to § 134a SGB V between the midwifery associations and the statutory health insurance funds.
  2. These services are generally billed directly to the statutory health insurance (GKV).
  3. Privately insured clients or self-paying clients will receive an invoice in accordance with the Private Fee Schedule for Midwives in Hesse (HebGebO HE) in the version currently in force.
  4. Services that are not part of GKV reimbursement (e.g. childbirth preparation for partners, additional consultations, courses without medical indication) are self-pay services.
    The midwife will inform clients in advance about the costs incurred.
  5. If a statutory health insurance fund does not meet its obligation to pay (e.g. due to lack of membership), the client is personally liable for the full remuneration.

 

 

5. Appointments and Cancellations

 

  1. Agreed appointments are binding.
  2. Cancellations must be made at least 24 hours before the appointment.
  3. In the event of late or unexcused cancellation, the midwife may charge a cancellation fee equal to the lost remuneration, provided the appointment cannot be reassigned. This cancellation fee is not covered by the health insurance.
  4. In the event of repeated late or unexcused cancellations, the midwife reserves the right to terminate the treatment contract.

 

 

6. Liability

The midwife is only liable for damages in cases of intent or gross negligence.

The midwife assumes no liability for health-related or other damages resulting from incomplete or incorrect information provided by the client.

 

7. Data Protection

The midwife processes personal data exclusively in accordance with applicable data protection laws (in particular the GDPR, BDSG, and HDSIG).

Data will only be passed on to third parties (e.g. billing offices, health insurance funds, physicians) insofar as this is legally permitted or expressly authorized.

A detailed privacy policy will be provided at the start of care.

 

8. Confidentiality

The midwife is subject to the statutory duty of confidentiality pursuant to § 203 of the German Criminal Code (StGB).

All personal or medical information obtained in the course of care will be treated confidentially.

 

9. Place of Jurisdiction and Applicable Law

German law shall apply.

The place of jurisdiction, insofar as legally permissible, is the registered office of the midwife in Bad Homburg, Hessen.

 

10. Severability Clause

Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a provision that comes closest to the economic purpose intended.
