Consent to Data Processing (GDPR)
I hereby consent to the processing of the data I have provided in compliance with the GDPR for the purpose of providing midwifery services. If no services have yet been provided, this consent may be withdrawn at any time. If services have already been provided, the data will be used solely to document and verify the proper handling of the services rendered to date (e.g. documentation of midwifery services, billing of midwifery services). Withdrawal of consent does not affect the lawfulness of data processing carried out on the basis of consent prior to withdrawal.
Your data will be irrevocably deleted after the expiry of the statutory retention periods for documentation and billing (30 years for home births, and 10 years in all other cases). Your data will not be passed on without your consent, except where required by law, such as for billing purposes.
I process data in accordance with applicable data protection regulations.
You generally have the right to access, rectification, erasure, restriction of processing, data portability, withdrawal of consent, and objection. If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been infringed, you may lodge a complaint with the supervisory authority.

1. Scope of Application
These General Terms and Conditions (GTC) apply to all midwifery services provided by midwife
Susanne Knauer, Foellerweg 30, 61352 Bad Homburg, to clients.
Deviating agreements shall only apply if confirmed in writing.
2. Range of Services
The midwife offers services within the scope of pregnancy counseling, childbirth preparation, postnatal care, counseling for breastfeeding and nutritional issues, as well as course offerings (e.g. postnatal recovery exercise, baby massage).
The exact scope of services results from the individual care agreement or the respective course description.
3. Conclusion of Contract
A care contract is concluded as soon as an appointment is agreed upon or a course place is bindingly booked.
The midwife reserves the right to decline inquiries in the event of capacity constraints or an unsuitable care situation (e.g. distances).

The midwife is only liable for damages in cases of intent or gross negligence.
The midwife assumes no liability for health-related or other damages resulting from incomplete or incorrect information provided by the client.
7. Data Protection
The midwife processes personal data exclusively in accordance with applicable data protection laws (in particular the GDPR, BDSG, and HDSIG).
Data will only be passed on to third parties (e.g. billing offices, health insurance funds, physicians) insofar as this is legally permitted or expressly authorized.
A detailed privacy policy will be provided at the start of care.
8. Confidentiality
The midwife is subject to the statutory duty of confidentiality pursuant to § 203 of the German Criminal Code (StGB).
All personal or medical information obtained in the course of care will be treated confidentially.
9. Place of Jurisdiction and Applicable Law
German law shall apply.
The place of jurisdiction, insofar as legally permissible, is the registered office of the midwife in Bad Homburg, Hessen.
10. Severability Clause
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a provision that comes closest to the economic purpose intended.

Consumers are entitled to a right of withdrawal under the following conditions: A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity. The midwife/midwifery practice points out the following to the participant: You have the right to cancel this contract within 14 days without giving reasons. The cancellation period is 14 days from the day the contract is concluded. In order to exercise your right of withdrawal, you must inform the midwife of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or by email). In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
Consequences of revocation
The midwife/midwifery practice must repay all payments received from the participant immediately, but at the latest within 14 days from the day on which notification of the revocation was received. If the participant has requested that the service begin during the cancellation period, she must pay the midwifery practice an appropriate amount that corresponds to the proportion of the service used up to that point.
